Notice of the Preparation of an Amendment to a Planning Scheme and Notice of an Application for a Planning Permit Given Under Section 96C of the Planning and Environment Act 1987
The land affected by the Amendment and the application is 196 and 198 Hawthorn Road, Caulfield North (Lot 9 and 10 on LP008216).
The amendment proposes to include land at 198 Hawthorn Road, Caulfield North in the Schedule to Clause 52.02 to enable the removal of a restrictive covenant in combination with an application for Planning Permit GE/DP-34438/2021 for the construction of a three-storey apartment building comprising 15 dwellings and a basement car park and alteration of access to a road in a Transport Zone 2 at 196 and 198 Hawthorn Road, Caulfield North, to be considered concurrently in accordance with Section 96A of the Planning and Environment Act 1987.
The applicant for the permit is 196 Hawthorn Road Pty Ltd.

Any person who may be affected by the Amendment or by the granting of the permit may make a submission to the planning authority about the amendment and the application. Submissions must be made in writing giving the submitter’s name and contact address, clearly stating the grounds on which the Amendment is supported or opposed and indicating what changes (if any) the submitter wishes to make.
Name and contact details of submitters are required for Council to consider submissions and to notify such persons of the opportunity to attend Council meetings and any public hearing held to consider submissions.
The closing date for submissions is 5 September 2022. A submission must be lodged on the Council website or sent to:

The planning authority must make a copy of every submission available at its office and/or its website for any person to inspect free of charge until two months after the amendment comes into operation or lapses.
