Proposed discontinuance and sale of part of Merriwoola Street, St Kilda East

Glen Eira City Council (Council), acting under section 206 and Schedule 10 Clause 3 of the Local Government Act 1989 and section 114 of the Local Government Act 2020 proposes to discontinue the northern section of Merriwoola Street, St Kilda East, which is shown hatched on the plan below.

If discontinued, Council proposes to sell the land from the road to the adjoining property owner, Caulfield Grammar School (the Purchaser), by private treaty in accordance with Council’s policies and on the following terms and conditions:

Price:   Being the current market value of the 1,526m2 of land, as assessed by Council’s valuer.

Other conditions of sale:

  • The Purchaser must reimburse Council its costs associated with discontinuing the road and selling the land.
  • That part of the land containing a South East Water sewer and a Council stormwater drain will be encumbered with an easement in favour of these authorities.
  • The Purchaser must set aside two 3m x 3m road spays from its property at 14 Tantram Avenue and 6 Merriwoola Street, St Kilda East.

In accordance with section 223 of the Local Government Act 1989 and as part of its Community Engagement process, Council is inviting submissions on this proposal.  Any person wishing to make a submission must do so in writing to the undersigned no later than Friday 20 January 2023.  Submissions should be addressed to:

Submissions may also be delivered to Council’s Service Centre, corner Glen Eira and Hawthorn Roads, Caulfield, or emailed to submissions@gleneira.vic.gov.au.

A person making a submission is entitled to request in the submission that they wish to appear in person, or to be represented by a person specified in the submission, in support of the submission at a meeting of Council or a Committee of Council on a date, time and place to be determined by Council.

Any person making a written submission, or exercising rights under Council’s Community Engagement Policy, is advised that all submissions or comments and personal information in the submission or comment will be handled by Council in accordance with the provisions of the Privacy and Data Protection Act 2014.

All submissions will be considered in accordance with section 223 of the Local Government Act 1989.

Following consideration of any and all submissions and compliance with Council’s Community Engagement Policy, Council will decide to discontinue and sell the road, discontinue and sell part of the road, or not to discontinue and sell the road.
