Proposed creation of easement part of Marlborough Reserve

Glen Eira City Council (Council) acting under section 189 of the Local Government Act 1989 (Act), proposes to create an easement over Council land at 77a Marlborough Road, Bentleigh East known as part of Marlborough Reserve and more particularly described as part of certificate of title volume 7891 folio 036 (Land), affecting 3.8 square metre of land on the south western corner of Marlborough Reserve. A plan is available from Customer Service for further clarification.

It is proposed that an easement be created over the Land in favour of United Energy in accordance with Council policy.

In accordance with section 223 of the Act, any person wishing to make a submission on the proposal must do so in writing no later than Friday 22 January 2021. Submissions should be addressed to:

A person making a submission is entitled to request in the submission that they wish to appear in person, or to be represented by a person specified in the submission, in support of the submission at a meeting of Council or its Committee on a date, time and place to be determined by Council.

Any person making a written submission under section 223 of the Act is advised that all submissions and personal information in the submission will be handled by Council in accordance with the provisions of the Privacy and Data Protection Act 2014.

All submissions will be considered in accordance with section 223 of the Act.

Following consideration of submissions, if any, Council may resolve to create the easement over the Land, or not to create the easement over the Land.
