The amendment requests that the Minister intervene to make a correction of a mapping anomaly at 1 St Georges Road, Elsternwick, to include a previously identified contributory rear garden (tennis court) to HO59. This historical error was made in Planning Scheme Amendment L33 from 1999, and will be fixed with this amendment

At the Council meeting held on 28 June 2022, it considered submissions received to the amendment. Pursuant to Section 23(1)(c) of the Planning and Environment Act 1987, it resolved to abandon the amendment on the following grounds:

In its capacity as the planning authority, considers that owners of land benefited by the restriction may suffer detriment (including any perceived detriment) as a consequence of the variation of the restriction.

This means that the combined planning permit application and planning scheme amendment has been refused and the process will not continue any further.
